Terms of Service
These terms are the agreement between you and us when you use MyOwnLingo (myownlingo.com). They are written to be read. If anything is unclear, write to hello@myownlingo.com.
1. Who we are
MyOwnLingo is run by Faresay Ltd, trading as Robin of Loxley, a company registered in England and Wales (company number [company number]), registered office [registered office address]. "We", "us" and "our" mean Faresay Ltd. You can reach us at hello@myownlingo.com.
2. What MyOwnLingo is
MyOwnLingo is a set of language-learning games that runs in your web browser. The free tier is level A1 in every language, plus the daily challenge. A paid subscription unlocks the other levels and games. We show what each tier includes on the site before you pay.
MyOwnLingo is a learning aid. We work hard to make the content right, but we don't promise it is free of mistakes, and it is not a qualification or a substitute for a teacher. If you spot a mistake, please tell us.
3. Your account
- You need an account to play. Give us a real email address so you can reset your password and receive receipts.
- Reminder emails (a daily reminder and a warning when a streak is about to end) are optional and off until you turn them on on your account page. Every reminder has a one-click unsubscribe link. We don't send marketing emails.
- You must be at least 13 to make an account. If you are under 18, a parent or guardian must agree to these terms and make any purchase for you.
- Keep your password to yourself. You are responsible for what happens under your account.
- Your username appears on scoreboards (unless you make your scores private). Don't choose one that is offensive, impersonates someone or contains personal details you don't want shown. We may change or remove a username that breaks this.
- You can delete your account at any time from your account page. That deletes your data as described in the Privacy Policy.
4. Paying
We sell the subscription. When you buy, your contract is with Faresay Ltd, under these terms. Payments are processed for us by Stripe (Stripe Payments UK, Ltd. and its affiliates), our payment processor. That means:
- Stripe takes the card payment on our behalf, on its secure payment page;
- we never see or store your card number: Stripe holds it;
- Stripe emails your receipts and invoices on our behalf;
- refunds are decided by us and paid back through Stripe (see the Refund Policy).
Where we sell it. The paid plan isn't currently sold to consumers who live in the European Union. When you subscribe we ask which country you live in, and Stripe asks for your billing address; if a purchase comes from a country we don't sell to, we cancel it and refund it in full straight away. Price. The subscription is US$5 a year. Prices include VAT where applicable. The payment page shows the exact amount before you pay. Your bank may charge a fee for paying in US dollars.
Renewal. The subscription renews automatically each year at the price then in force until you cancel. If we change the price, we'll tell you by email at least 30 days before your next renewal, and you can cancel before it applies.
Cancelling. You can cancel at any time under Manage subscription on the site, which opens Stripe's customer portal, or by writing to us. Cancelling stops the next renewal; you keep paid access until the end of the year you have paid for. Deleting your account cancels the subscription straight away.
5. Your right to cancel (UK and EU consumers)
If you are a consumer in the UK or the EU, the law usually gives you 14 days to cancel an online purchase. For digital content that starts straight away, that right ends once you have started using it, but only if you agreed to immediate access and acknowledged that you would lose the right to cancel. At checkout we ask you to do exactly that, because the paid games unlock the moment you pay.
Even so, we'll give you a full refund if you ask within 14 days of your first payment, and within 14 days of a yearly renewal charge. [decide: keep this goodwill refund or not] See the Refund Policy. This doesn't affect your statutory rights.
6. Using MyOwnLingo fairly
Please don't:
- use bots, scripts or anything automated to play, to post scores or to copy the content;
- try to get into accounts or parts of the service that aren't yours, or to disrupt or overload it;
- share a paid account with people outside your household, or resell access;
- use friends groups or usernames to harass anyone.
If you do, we may remove scores, suspend or close the account. Unless the breach is serious, we'll warn you first.
7. The content
The games, words, sentences, grammar notes, stories and design belong to us or to the people who licensed them to us. Some sentences come from openly licensed sources such as Tatoeba and are used under their licences, with credit. You may use MyOwnLingo for your own learning, including in a class you teach. Please don't copy the content in bulk or republish it.
8. Changes and availability
We keep improving MyOwnLingo, so games, levels and features will change. We'll try to keep the site running all the time but can't promise it will never be down. If we make a change that takes away something important you have paid for, we'll tell you and you can cancel and get a refund for the unused part of your year.
If we ever close MyOwnLingo, we'll give you at least 30 days' notice by email and refund the unused part of any paid year.
9. Our responsibility to you
If we fail to meet these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that failure. We are not responsible for loss that wasn't foreseeable, or for business losses: MyOwnLingo is for personal learning.
Apart from that, our total liability to you is limited to the amount you paid for MyOwnLingo in the 12 months before the problem.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit, and nothing affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 if the service isn't as described or is faulty.
10. Ending the agreement
You can stop using MyOwnLingo and delete your account at any time. We can close an account for a serious or repeated breach of these terms. If we close your account without that kind of reason, we'll refund the unused part of any paid year.
11. Changes to these terms
We may update these terms, for example when the law or the service changes. The date at the top shows the latest version. If a change matters to you, we'll tell you by email or on the site before it takes effect. If you don't agree, you can cancel before it applies.
12. Law and disputes
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can also bring a claim there, and if you live in the EU you keep the protections of the consumer law of your country. Please talk to us first at hello@myownlingo.com: most things can be sorted out quickly.
